The Historic Monuments and Archaeological Objects (Northern Ireland) Order 1995
Under this legislation damaging or carrying out unauthorised work within a protected area without consent is punishable by fines of up to £5,000. A scheduled monument is defined by a red line on a map notified to owners and placed as a charge in the Land Registers of Northern Ireland. Scheduled Monument Consent must be sought for any of the following operations:
- any works resulting in the demolition , destruction or disturbance of , or any damage to, a scheduled monument;
- any works for the purpose of removing or repairing a scheduled monument or any part of it or of making any alterations or additions thereto; and
- any flooding or tipping operations on land in, on or under which there is a scheduled monument.
